Insurance Coverage Litigation

 Defective Phone System Is Not “Property Damage”

Steven E. Leder obtained summary judgment in the United States District Court for the Middle District of Tennessee on April 14, 2004 . The Leder Law Group, LLC represented a national insurer in an insurance coverage action concerning whether a defective telephone system sold by the insured constituted “property damage” under a commercial general liability policy. Fellow Employee Exclusion Valid Over Minimum Limits

Steven E. Leder and Katherine D. Bainbridge successfully obtained an affirmance in an insurance coverage case on certiorari to the Maryland Court of Appeals in Taylor F. Wilson v. Nationwide Mutual Insurance Company, No. 22, September Term, 2006 on November 14, 2006 . The Court upheld the validity of step-down provisions for fellow employees in business auto policies. Business Auto Policies that provide minimum limits to fellow employees and higher limits to the employer are valid and enforceable. This decision extended to fellow employee claims the Court’s ruling in Stearman v. State Farm Mut. Auto. Ins. Co., 381 Md. 436 (2004) concerning the “Household Exclusion”. Wilson v. Nationwide Mut. Additional Insured Not Covered For Own Negligence

Steven E. Leder and Katherine D. Bainbridge obtained summary judgment in the United States District Court for the District of Maryland on behalf of a national insurer in an insurance coverage action against the insurer by an additional insured under a CGL policy. The court held that a blanket additional insured endorsement did not cover the additional insured for its own negligence. Bituminous Cas. Corp. v. Nelcorp Co. of Md . MJG 05 CV 910

Summary Judgment In Alleged Lead Poisoning Cases

Thomas W. Hale obtained summary judgment for a defendant in the Circuit Court for Baltimore City in a lead-based paint poisoning case in April 2006. Saunders v. Kirson, Case No. 24-C-03-007346.

Premises Liability

Defense Jury Verdict in Slip & Fall Case

Steven E. Leder and Thomas W. Hale obtained a jury verdict on behalf of Burger King Corporation and Tico Restaurants, LLC , in the Circuit Court for Baltimore County, 03-C-12588 in a slip and fall case on February 27, 2006.

 

Recreational Boating

 Defense Verdict In Alleged Breach of Yacht Policy Case

Thomas W. Hale obtained a defense verdict on behalf of BOAT US and CNA in an action for breach of a yacht policy. The plaintiff alleged that he left his boat on a trailer in a high crime commercial district to get air for his spare tire and when he returned the boat was gone. Mr. Hale demonstrated that the plaintiff passes several other services stations, stopped for gas and dinner before returning to the boat. Further the purchase price on the policy application was double the true price. Houd Zidan v. Boat US, Inc., et al., District Court of Maryland for Baltimore County , Case No. 6099-2005.

Steven E. Leder was an instructor at Deposition Practice and Procedure, a clinic sponsored by the Maryland Institute for Continuing Practical Education of Lawyers.

Steven E. Leder was a panelist at “The Construction Process From Start to Finish In Maryland” seminar sponsored by Lorman, April 20, 2006 . Mr. Leder presented a survey on coverage for the construction industry.

Steven E. Leder will speak at a MICPEL Insurance Seminar later this year.
