How do You Measure Success?
Our clients’ objective is typically to achieve cost-effective results once their responsibilities and liability are established. Success is measured against potential exposure, whether it means settling the case, taking it to trial or winning on summary judgment. It may mean scaling down the case so that the trial is less expensive and the amount at risk is manageable.
  • We’ve won numerous cases on summary judgment, such as cases involving coverage for warehousemen’s legal liability , and wrongful termination. We avoided national litigation concerning insurance coverage in the racehorse and greyhound industry with a win on summary judgment.
  • Sometimes it means a nuisance settlement where liability is questionable. For example, we settled a claim for the destruction of the videotape from a TV pilot for less than $2,000. We’ve settled numerous multi-million dollar construction coverage claims on favorable terms, such as 10 cents on the dollar.
  • We’ve tried cases successfully, either to a defense verdict or to limited recovery. For example, recently where the client overfilled a heating oil tank so that oil spread throughout the plaintiff 's basement. We advised the client to clean up the spill and provide housing for the plaintiffs. This limited the plaintiff’s recovery (above clean up and housing) to $5,000.
